This policy applies to RIB Software International Limited (“RIB”) Company Number 1777950 and its associated companies. All these are collectively referred to in this policy as “we”, “our” and “us”.

We will endeavour to handle your personal information in accordance with our Privacy Policy and privacy legislation applicable in the countries where we operate.

This Privacy Policy summarises how we handle your personal data. We may revise this Privacy Policy from time to time by updating this page. The revised Privacy Policy will take effect when it is posted on our website.

What is personal information?

Personal data means information or an opinion about an identified individual, or an individual who is reasonably identifiable:

  • whether the information or opinion is recorded in a material form or not.

    • Personal details including names, addresses, telephone numbers, email addresses and occupation
    • Information regarding your relationship with us
  • Suppliers and their employees
    • Personal details including names, addresses, telephone numbers and email addresses
    • Bank account details
  • Prospective employees and contractors
    • Application letters and resume details which will usually include details such as name, address, contact details, academic qualifications, employment history and referees

How do we collect your personal information?

Where possible, we will collect your personal information directly from you. This may be

  • in person (for example, at meetings or trade show events, business cards),
  • on the telephone (for example, sales enquiries, support calls), or
  • online (for example, online enquiries through our website).

Additionally, when you browse our website, we collect information about your visit to our website and your web browsing. That information may include your IP address, your operating system, your browser ID, your browsing activity, and other information about how you interacted with our website. We may collect this information as a part of log files as well as through the use of cookies or other tracking technologies.

We may also obtain personal information from third parties (for example, a referral or a reference). If we collect personal information about you from a third party and it is unclear that you have consented to the disclosure of your personal information to us, we will take reasonable steps to contact you and ensure that you are aware of the circumstances surrounding the collection and purposes for which we collected your personal information.

Why do we collect your personal information?

We may collect your personal information for a number of purposes, including:

  • Marketing: to communicate with you about products and releases
  • Purchasing: to purchase goods and/or services from you or your company
  • Support services: to provide you with information and support services
  • Software licencing: to allow use of our software activating against a valid licence and to detect and prevent fraud
  • Other issues: communicating with you in relation to our operations, activities and objectives, to verify your identity, to improve and evaluate our programs and services and to comply with relevant laws.

The legal basis for the processing of your personal information is Legitimate Interest, but only if necessary for the purpose that we collected it for. You have the right to opt-out from this at any time. An opt-out link is included with all email communication sent, or alternately you can email int.dataprotection@rib-software.com to be removed from all mailing lists.

By processing your Personal Information under Legitimate Interest you will receive any specific piece(s) of information you requested, and we may also send you appropriate and useful communications where relevant.

Where we collect your personal information for a specific purpose not outlined above, we will explain the primary purpose and any related secondary purposes for which we are collecting your personal information.

Sensitive information / Special Categories of Personal information

Sensitive information or Special Categories of Personal information includes the following type of information about an individual: racial or ethnic origin, membership of a political association or trade union, political beliefs, religious beliefs, philosophical beliefs, genetic data, biometric data, health data, gender or sexual orientation. While we do not foresee a need to use or disclose any sensitive information, we may collect sensitive information as part of operation of our business. Sensitive information will only be used and disclosed for the purpose for which it was provided or a directly related secondary purpose unless you agree otherwise or where certain other limited circumstances apply (for example, where required by law).

What happens if you don’t provide all this information?

If you do not provide some or all of the personal information requested, we may not be able to offer you services or provide you with information about our business and products.

Using a pseudonym or engaging with us anonymously

Where practicable, you will be given the opportunity to engage with us on an anonymous basis, or using a pseudonym.

Website usage information and cookies

When you access our website, we use software embedded in our website and we place small data files (or cookies) on your computer or other device to collect information about which pages you view and how you reach them, what you do when you visit a page, the length of time you remain on the page, and how we perform in providing content to you.

A cookie does not identify individuals personally, but it does identify computers. You can set your browser to notify you when you receive a cookie and this will provide you with an opportunity to either accept or reject it in each instance.

When you visit our website we will record your IP address through Spotler. This address will be matched against public and proprietary IP address databases to provide us with information about your visit. This information may identify the organisation to whom the IP address is registered but not individuals.

Our websites also use Google Analytics, a web analysis service of Google, Inc (“Google”). You can learn more from their Terms of Service and Privacy Policy. We use Google Analytics features for usage tracking and marketing analytics such as Remarketing, Google Analytics Demographics, and Interest Reporting. These features use first party and third party cookies to inform and optimise content based on your past visits to our site.

Google Analytics and Spotler inform us of how visitors use our site based on your browsing habits, so that we can improve our site to make it easier for you to find the information you are seeking. Google also receives the information from Google Analytics as you browse our site and other websites on the Google Display Network using Remarketing.

If you would like to opt out of customised Google Display Network services and Google Analytics for Display Advertising you can use Ad Settings. You can also use the Google Analytics Opt out Browser Add on so you are not tracked into Google Analytics.

To whom do we disclose your personal information?

Subject to any exceptions set out in any privacy regulation for the country where we collected the information (for example, the disclosure of personal information when allowed or required by law), we will only use and/or disclose your personal information for:

  • the primary purpose for which it is collected; or
  • a related purpose, where you would reasonably expect that it be used and/or disclosed without your further consent.

This may include disclosing information to sub-processors such as:

  • Our distributors or agents.
  • Other companies or individuals who assist us in providing products and services or perform functions on our behalf (for example, specialist consultants).
  • Regulatory authorities.
  • Anyone else to whom you authorise us to disclose it.

Sending personal information overseas

We store and process your personal information in the regions where we have a permanent establishment. All personal information, no matter where it is stored, is stored and used in accordance with this Privacy Policy.

How is your personal information stored

We take all reasonable steps to protect all of the personal information we hold from misuse, interference and loss, and from unauthorised access, modification or disclosure. Your personal information will be stored on a password protected electronic database, which may be on our database, a database maintained by a cloud hosting service provider or other third party database storage or server provider. Backups of electronic information are written to tapes which are stored offsite.

Hard copy information is generally stored in our offices, which are secured to prevent entry by unauthorised people.

Where personal information is stored with a third party, we have arrangements which require those third parties to maintain the security of the information. We take reasonable steps to protect the privacy and security of that information, but we are not liable for any unauthorised access or use of that information.

Your personal information will stay on the database indefinitely until you advise you would like it removed, or we destroy it earlier in accordance with privacy law requirements.

Access to your personal information

We will, upon your request, and subject to applicable privacy laws, provide you with access to your personal information that is held by us. However, we request that you identify, as clearly as possible, the type(s) of information requested. We will deal with your request to provide access to your personal information within 30 days and you agree we may charge you our reasonable costs incurred in supplying you with access to this information.

Your rights to access personal information are not absolute and privacy laws dictate that we are not required to grant access in certain circumstances such as where:

  • access would pose a serious threat to the life, safety or health of any individual or to public health or public safety
  • access would have an unreasonable impact on the privacy of other individuals
  • the request is frivolous or vexatious
  • denying access is required or authorised by a law or a court or tribunal order
  • access would be unlawful, or
  • access may prejudice commercial negotiations, legal proceedings, enforcement activities or appropriate action being taken in respect of a suspected unlawful activity or serious misconduct.

If we refuse to grant you access to your personal information, we will provide you with reasons for that decision (unless it is unreasonable to do so) and the avenues available for you to complain about the refusal.

Your Ability to Change, Transfer or Delete Your Personal Information

You may ask us to for access to your personal information or to update, correct, transfer or delete the personal information we hold about you at any time. We will take reasonable steps to verify your identity before granting access or making any corrections to or deletion of your information. We also have obligations to take reasonable steps to correct personal information we hold when we are satisfied that it is inaccurate, out of date, incomplete, irrelevant or misleading for the purpose for which it is held.

Consent

By submitting data to us and/or using our website you give your consent that all personal data that you submit may be processed for use in the manner and for the purposes identified at the time of collecting the data and those purposes described in this privacy policy. Where we are asking you for sensitive personal data we will always tell you why and how the information will be used.

Complaints

If you have any queries or would like to make a complaint regarding relating to our Privacy Policy or the manner in which we handle your personal information, please contact us by email: int.dataprotection@rib-software.com. We endeavour to respond to complaints and queries within fourteen days of their receipt. If you are dissatisfied with our response, you may refer the matter to the relevant government agency for the country.
